Apple faces a new battle over patents. This time there is a fight with Samsung, although it has to do with the mobility sector.
Google, which said it would defend the interests of Android and its
partners claim to the block of seven Motorola patents related to Siri,
the location of the iPhone, and notifications for e-mail, among others.
The lawsuit comes on the heels of Motorola and is the first to be
presented in relation to its patents since joining the company owns the
world's largest search engine and the most widespread mobile ecosystem. Motorola was eventually acquired by Google last May after some reluctance of U.S. antitrust agencies, Europe and China.
Now, Motorola, with this new situation, feel sufficiently prepared and motivated to litigate with the U.S. again.
According to Bloomberg, the complaint discloses seven basic
characteristics possessed by the iPhone and that, says Motorola,
copyright infringing its patents.
Among them is the voice control software for iOS Siri, and a reminder of location, email notification and a video player.
The accusation comes after a failed attempt by Motorola into an agreement with Apple.
"Unwillingness of Apple"
"We want to resolve these issues of patents, but Apple's unwillingness
to resolve a license leaves us no alternative but to defend the
innovations of our engineers," said Motorola Mobility, in a statement
published by Bloomberg. For its part, Apple has refused to comment.
The suit has been filed with the International Trade Commission. It is an organ that regulates U.S. commercial malpractices that could undermine the market.
This was done so because most of the components of Apple devices are made in Asia, even if it's two U.S. companies. In addition, Motorola seeks to restrict the import of such products to the United States. This would mean a blow against the company co-founded by Steve Jobs.
Apple, meanwhile, has reported that this body is not right for the
litigation, and that should be a trial in a federal district. Such is the case against Samsung, which governs federal court in California.
The situation is further complicated when the 24th of this month
disclosed the final resolution of the previous lawsuit between the two
companies, after Apple's appeal. In the previous resolution, justice in his favor Motorola over a patent that the U.S. accused of plagiarism. This affects the WiFi wireless technology of 'smartphone'.
On the other hand, Motorola accused Apple last March by three patents at the Washington Bureau. However, the judge ruled in favor of Motorola again.
As for the tension between Google and Apple, the competition between
Android and iOS is constant, since Android occupies most of the world's
mobile devices.
Apple, Android and manufacturers against
It seems that Apple is a powerful enemy of all companies related to the sector of mobile devices.
However, Google has picked up the baton and a few months ago, Eric
Schmidt said it would defend its members to protect their developing
Android ecosystem.
However, in addition to seeing Android plagiarized from iOS, Apple is
particularly active and is particularly worried about lawsuits with
Samsung. Something that also is reciprocal. The patent lawsuit against Samsung that is occupying the media and is costing both time and money great.
However, this only serves to reinforce the leadership of both, that
last Friday experienced its greatest rise in the stock of New York for
the launch of the iPhone 5. Meanwhile, the market share of Samsung is growing in the mobile phone sector.
